Work permits can be broadly classified into two groups: LMIA-Exempt work permits and LMIA-Based work permits. Under certain specific categories, a foreign national may work in Canada without a work permit, for instance, under the International Mobility Program (IMP), that aims to promote Canada’s broad economic, social, and cultural interests.

The purpose of the work application is to prove that the foreign worker meets the requirements of the particular category, such as education, work experience and skill requirements, and that he/she is not inadmissible to Canada.

LMIA

Before recruiting a foreign worker, a Canadian business may need to apply for a Labour Market Impact Assessment (LMIA) from Employment and Social Development Canada (ESDC). It demonstrates that there is a need for a foreign worker to fill the position. While making a decision on the LMIA application ESDC must evaluate whether the employment of the foreign national is likely to have a neutral or positive effect on the labor market in Canada.

A positive LMIA gives the employer permission to hire a temporary foreign worker.

Employers can get the LMIA application approved to support a foreign national’s permanent residence application or hire them as a temporary foreign worker. They need to provide their business or tax documents and records to ESDC for the assessment of genuineness of LMIA application, if required.
